These Terms and Conditions govern your access to and use of highendnj.com, including its online menu, ordering features, customer accounts, Rewards program, mobile services, promotions, and related services.

The website is operated by High End Dispensary, located at 109 Water St, South River, NJ 08882. You may contact us at info@highendnj.com or 732-353-6443.

By visiting the website, creating an account, placing an order, or using any related service, you agree to these Terms. Don’t use the website if you don’t agree.

1. Age and Eligibility

The website and adult-use cannabis services are intended for people who are at least 21 years old.

By using the website or placing an adult-use order, you confirm that you are at least 21 years old and legally permitted to purchase cannabis in New Jersey.

Eligible medical cannabis patients and caregivers may make purchases under separate New Jersey program requirements.

You may be required to show valid government-issued identification when entering the store, picking up an order, receiving a delivery, or completing a purchase. An online age gate or date-of-birth entry doesn’t replace in-person identification requirements.

We may refuse service, cancel an order, or restrict access when we can’t confirm age, identity, eligibility, or legal compliance.

2. Cannabis Laws

Cannabis remains regulated under federal and state law. You are responsible for understanding and following the laws that apply to your purchase, possession, transportation, storage, and use.

Cannabis purchased from High End Dispensary may not be:

– Sold or transferred to a person under 21

– Transported across state lines

– Mailed or shipped through interstate services

– Resold without a valid license

– Used where cannabis consumption is prohibited

– Used before or while driving or operating machinery

– Possessed in quantities exceeding legal limits

Purchase and possession limits may change. The limits applied at checkout or in the store will control when required by law or regulation.

Don’t purchase or use a product if you have concerns about its ingredients, packaging, condition, authenticity, or labeling. Contact the store before using it.

6. Online Orders

Submitting an online order is a request to reserve products. It isn’t a completed sale or a guarantee that every product will be available.

An order becomes final only after:

– We confirm the products are available

– We verify your identity and eligibility

– You satisfy applicable purchase limits

– Payment is accepted

– The transaction is completed in accordance with New Jersey law

We may reject, limit, modify, or cancel an order because of:

7. Pickup Orders

Online orders may be picked up inside the store.

You must bring valid identification and any other documents required for the transaction. The name on the order may need to match the customer completing the purchase.

A pickup notice doesn’t guarantee immediate service or waive identification, payment, purchase-limit, or legal requirements.

Orders may be returned to inventory if they aren’t picked up within the stated pickup period or before closing. We may change or discontinue order-hold periods at any time.

Unless expressly confirmed, online pickup isn’t curbside pickup and doesn’t include drive-through service.

8. Delivery

Delivery may be offered after the service launches. Availability may depend on your address, age, order value, operating hours, local rules, driver availability, and other conditions.

Delivery terms may include:

– A permitted service area

– Minimum or maximum order amounts

– Delivery fees

– Delivery hours

– Identification requirements

– Address verification

– Recipient requirements

– Payment restrictions

– Delivery windows

– Failed-delivery charges

These details will be shown when delivery becomes available.

Delivery estimates aren’t guaranteed. Traffic, weather, staffing, demand, safety concerns, regulatory restrictions, and incorrect customer information may cause delays or cancellation.

The eligible customer who placed the order must generally be present to receive it and show valid identification. Products won’t be left unattended or delivered to an ineligible recipient.

9. Prices, Taxes, and Fees

Prices are shown in United States dollars.

Prices may change without notice. The price confirmed during the final transaction will control, subject to correction of obvious errors.

Cannabis transactions may be subject to New Jersey sales tax and any other lawfully required taxes or charges.

Payment-provider, debit, ATM, delivery, or other service fees may apply when disclosed before completion.

We may refuse to honor a price caused by a typographical, technical, menu-integration, or system error.

10. Payment

High End Dispensary may accept cash, debit, Dutchie Pay, and other payment methods made available at checkout or in the store. Two ATMs are available on site.

Payment methods may be provided by independent companies. Their own terms, privacy policies, limits, fees, verification requirements, and service availability may apply.

Traditional credit cards shouldn’t be assumed to be accepted unless they are specifically listed as available.

You confirm that:

– You are authorized to use the payment method

– The information you provide is accurate

– You will pay all approved charges

– You won’t initiate an improper chargeback or payment dispute

11. Refunds, Returns, and Exchanges

Cannabis products are generally final sale once they leave the store, except where a return, replacement, or refund is required by law or approved because of a verified product issue.

We may review requests involving:

– Incorrect products

– Damaged or defective products

– Broken seals before delivery or pickup

– Missing items

– Product recalls

– Manufacturer-approved returns

– Billing errors

Keep the product, original packaging, receipt, and labels until the issue is reviewed. Don’t consume or discard a product that you claim is damaged, contaminated, mislabeled, or defective unless safety requires otherwise.

We may require photographs, order information, or an in-store inspection. Approval isn’t guaranteed.

Products that were opened, used, improperly stored, or damaged after purchase may not qualify.

Refunds, if approved, may be issued through the original payment method, store credit, replacement product, or another lawful method.

12. Customer Accounts

Some website, app, ordering, or Rewards features may require an account.

You agree to:

13. Rewards Program

High End Dispensary may offer a customer Rewards program.

Unless separate Rewards terms state otherwise:

– Membership is free

– Membership is personal and nontransferable

– Members may need to be at least 21

– Points have no cash value

– Points can’t be sold or transferred

– Points aren’t property

– Points may be corrected when awarded in error

– Returns may reduce points

– Rewards may be subject to exclusions

– Membership may be terminated for abuse or fraud

The planned program awards 0.5 points for every dollar spent. Redemption values, benefits, and program tiers remain subject to the final Rewards rules.

We may modify, suspend, or end the Rewards program as permitted by law. Material changes may be announced through the website, account, email, app, or store.

14. Discounts

High End Dispensary may offer discounts to eligible Rewards members, including:

– Veteran Discount, 25 percent

– NJ MMP Discount, 15 percent

– Industry Discount, 10 percent

– First Responders and Law Enforcement Discount, 10 percent

– Students and Educators Discount, 10 percent

Discounts may require valid identification or proof of eligibility.

Unless stated otherwise:

– Discounts can’t be exchanged for cash

– Discounts may not be combined

– Discounts may exclude certain products

– Discounts may be limited by law or vendor restrictions

– Discounts may be corrected or denied when applied in error

– Eligibility may need to be verified for each purchase

– Discount terms may change

The terms shown with a specific discount will control if they differ from this section.

15. Promotions, Giveaways, and Events

Promotions, raffles, giveaways, contests, product drops, and events may have separate official rules.

Participation may be limited by:

Promotional items have no cash value unless the official rules state otherwise.

App availability, features, links, and compatibility may change.

We don’t guarantee that the app will work on every device or remain available indefinitely.

17. Text Messages and Email

You may choose to receive promotional email or text messages.

By providing consent, you authorize High End Dispensary and its service providers to send messages to the contact information you submitted.

Consent to marketing isn’t required to purchase cannabis.

You may unsubscribe from marketing emails through the unsubscribe link. You may opt out of marketing texts by replying STOP. Message and data rates may apply. Message frequency may vary.

We may continue sending transactional or service messages concerning active orders, account security, legal notices, or direct customer service requests.

18. Acceptable Website Use

You may use the website only for lawful personal purposes.

You may not:

– Violate any law or regulation

– Attempt to purchase cannabis while ineligible

– Submit false identification or account information

– Evade purchase limits

– Resell products unlawfully

– Access another user’s account

– Interfere with website operation

– Introduce viruses or harmful code

– Scrape or copy the menu through automated means

– Attempt to bypass security controls

This obligation doesn’t apply to claims caused solely by High End Dispensary’s unlawful conduct.

Any legal action relating to these Terms, the website, or a transaction must be filed in a court with proper jurisdiction in New Jersey, unless applicable consumer law requires another location.

Before filing a claim, you and High End Dispensary agree to make a reasonable effort to resolve the dispute directly.

Our failure to enforce a provision doesn’t waive our right to enforce it later.

A waiver is effective only when it is in writing and signed by an authorized representative of High End Dispensary.

28. Severability

These Terms, our Privacy Policy, and any rules presented for a specific order, promotion, Rewards program, delivery service, or mobile app form the agreement governing your use of those services.
